Wordmarks, logos, slogans, shapes, colours and sounds — what qualifies for protection under the Trade Marks Ordinance, 2001, and what does not.
A trade mark is one of the most valuable intellectual property assets a business can own. It protects your visual identity, secures brand goodwill, and distinguishes your goods or services from competitors in the marketplace.
However, not every name, symbol, or design qualifies for legal protection. For business owners, entrepreneurs, and startups in Pakistan, understanding what is registrable under local IP laws is crucial to avoiding costly application rejections at the Intellectual Property Organization of Pakistan (IPO-Pakistan).
This guide outlines what can (and cannot) be registered as a trade mark in Pakistan, the core legal requirements, and practical steps to secure statutory protection.

Under Section 2(xlvii) of the Trade Marks Ordinance, 2001, a trade mark is legally defined as:
"Any mark capable of being represented graphically and capable of distinguishing the goods or services of one undertaking from those of other undertakings."
In essence, a trade mark serves as a badge of origin, letting consumers know exactly who stands behind a product or service.
Pakistani trade mark law accommodates a wide variety of visual and non-traditional identifiers across the 45 classes of the Nice Classification system.
Consists of words, individual letters, numbers, or alphanumeric combinations.
Visual designs, stylized symbols, emblems, or graphical icons used to represent a company.
A hybrid mark that combines word elements with a graphical logo.
Catchphrases or slogans that have acquired distinctiveness and are directly connected with a brand in the public mind.
Three-dimensional shapes, distinctive product packaging, or unique container designs.
Under Sections 14 (Absolute Grounds) and Section 17 (Relative Grounds) of the Trade Marks Ordinance, 2001, IPO-Pakistan will reject applications under the following circumstances:
| Exclusion Category | Description & Legal Grounds | Examples |
|---|---|---|
| Generic / Descriptive | Marks that directly describe the kind, quality, or characteristics of the product. | "Soft Bread" for bakery items, "Fresh Milk" for dairy. |
| Deceptive / Misleading | Marks that deceive consumers regarding the nature, origin, or quality of goods. | Using "USA Made" for a locally manufactured item. |
| Offensive or Immoral | Signs contrary to public morality, religious sentiments, or national integrity. | Words/symbols offensive to Islamic or cultural values in Pakistan. |
| Confusingly Similar | Marks identical or deceptively similar to an existing registered mark in the same class. | Adopting "Nikey" or "Khaadii" to imitate established brands. |
| State Emblems & Flags | National flags, government insignias, and international body seals (UN, WHO, Red Crescent). | Including the State Emblem of Pakistan on private commercial goods. |
To pass examination by the Trade Marks Registry, your mark must satisfy five legal pillars:
Yes. Personal names can be registered under Section 2(xxiv) of the Ordinance provided they are distinctive, used commercially, and do not cause confusion with existing public figures or businesses in the same industry.
Yes, but only under different Nice Classes. Two businesses can hold similar marks if their goods or services are completely unrelated (e.g., Delta for an airline vs. Delta for faucets) and there is no likelihood of consumer confusion.
Initial trade mark registration in Pakistan is valid for 10 years from the filing date on Form TM-1. It can be renewed indefinitely every 10 years upon paying the prescribed renewal fees.
